What Is Ordinary Negligence?

Negligence occurs when a person fails to act with the level of care that a reasonably prudent person would use under similar circumstances. Many personal injury claims are based on allegations of negligence.

For example, a driver who briefly looks at a phone and causes a collision may be accused of acting negligently. The conduct may be careless, but it does not necessarily show a complete disregard for safety.

For example, Texas Civil Practice and Remedies Code § 41.003 permits exemplary damages in certain situations involving gross negligence, fraud, or malice. The specific requirements vary depending on the facts of the case.

As a result, proving gross negligence can have important legal and financial implications.

How Courts Evaluate the Evidence

Courts do not rely on labels alone when deciding whether conduct was grossly negligent. Instead, they examine the facts, circumstances, and available evidence.

Witness testimony, photographs, surveillance footage, expert opinions, and other records may help establish the nature of the conduct. The goal is to determine whether the behavior went beyond ordinary carelessness.

Each case is evaluated on its own facts rather than a predetermined formula.

Common Situations Where Gross Negligence Is Alleged

Claims involving dangerous driving, workplace accidents, defective products, or serious safety violations sometimes include allegations of gross negligence. However, not every serious accident automatically meets that standard.

A severe injury does not necessarily prove gross negligence occurred. Courts focus on the defendant’s conduct rather than the outcome alone.

This distinction is one reason these cases can become highly contested.
