Reaching a settlement agreement often feels like the finish line of a long legal process, but there are still several steps that need to happen before funds actually arrive. Understanding this sequence helps set realistic expectations rather than assuming a check will show up the moment an agreement is reached.

Finalizing the Settlement Agreement

Both parties need to formally agree to and sign the settlement terms, which can take time depending on how complex the negotiation has been and how many parties are involved. Even a straightforward case can take longer than expected if either side needs additional internal approvals.

Preparing Release Documents

Legal release documents, which waive further claims related to the case, typically need to be drafted, reviewed, and signed before any funds are processed. Reviewing this document carefully with an attorney before signing is an important step not to rush through.

Insurance or Defendant Processing Time

Once documents are signed, the paying party, often an insurance company, needs internal time to process the payment, which can take anywhere from a few days to several weeks depending on the organization. Larger insurance companies sometimes have more layers of internal approval, which can extend this stage further.

Funds Are Sent to the Attorney’s Trust Account

Settlement funds typically go first into an attorney’s trust account rather than directly to the plaintiff, which is a standard part of the legal process designed to ensure proper handling of the funds. This step exists to protect both the plaintiff and ensure all obligations are properly accounted for. If pre-settlement funding was used through a provider such as USClaims, repayment is typically handled during this stage before the remaining settlement proceeds are distributed. 

Outstanding Liens and Fees Are Resolved

Before disbursing money to the plaintiff, the attorney typically resolves any outstanding medical liens, legal fees, or other obligations tied to the case, which can add additional time to the process. Negotiating down a large medical lien, in particular, can sometimes take several additional weeks.

The Settlement Check Is Issued to the Plaintiff

Once all deductions are finalized, the remaining balance is issued as a settlement check to the plaintiff, officially completing the financial side of the case. Many attorneys provide a clear breakdown of deductions alongside the check itself.

Final Case Closure

With funds disbursed, the attorney typically closes out the case file, though plaintiffs should keep their own records in case questions arise later regarding taxes or other financial matters. Keeping a copy of the final settlement statement is particularly useful for future reference.

Each of these steps takes time, and the overall timeline can vary significantly based on case complexity and the parties involved. Knowing what to expect at each stage makes the waiting period feel less uncertain, even when the exact timing isn’t fully within anyone’s control. Checking in periodically with the attorney’s office is a reasonable way to stay informed without adding unnecessary pressure to the process.
